janlokpal 2011

Post by bond777 » Sat Aug 20, 2011 10:54 pm

1) All government employees should be included under JanLokpal. It requires around 20000 to 80000 employee. Less than Delhi police. But taking care of whole country!

Many of them will come from CBI anti corruption division, CVC....But now they will be not in pressure against whom the are doing investigation.

2) For common people(As there is corruption in passport office, ration office, Property registration dept….), There should be citizen charter, which indicates that what is maximum time limit that a particular work related to public can be done. e.g. ration card, licenses...If it is not so they have to ans., if they are not answering departmental head has to do. If he/she does not do in one month, we can complain to JanLokpal. Putting a Citizen's charter will reduce the corruption in these offices by making Govt officials more responsible

3) It is Lokpal responsibility to take care of RTI activists if needed. As RTI activists are Indian citizens - They have fundamental rights, it is the duty of the Govt to protect them.

4) MPs can not be leaved free to do scam like, vote for money

5) If there are allegation of corruption against PM, 7-10 members bench of lokapl(which includes previous judges, senior officers of different department like election commion.....) in a open hearing should decide if there are proofs if yes, investigation need to be start. After that court only has to decide on the basis of investigation.

6) Anti-corruption division of CBI should come under Lokpal, as most of the time it investigate the corruption cases against those who have power to control them.

7) If a allegation of corruption are against some Judge, a 7-10 members bench of lokapl(which includes previous judges, senior officers of different department like election commion.....) in a open hearing should be able to decide if there are proofs, if yest then investigation need to be started. After that court only has to decide on the basis of investigation.

‎8. If Lokapl member come to know about any case of corruption is not investigated or filed, it would be the responsibly of lok pal agency.... it should not wait for complain from any one to take action. Because many time its tough for common people to file case against powerful MPs, bureaucrats.....

Pappuji,

Janlokpal is a two-way sword. Without, right to recall-corrupt lokpal and transparent complaint procedure clauses, it will destroy honest officials and small-medium businessmen. Now, Anna also supports RTR-lokpal. So, please support also and ask IAC people to add RTR-lokpal and transparent complaint procedure clausese to janlokpal. Please find these clauses at

How will Lokpal members be accountable according to JanLokpal Bill?
Team Anna's view: A citizen can make a complaint to the Supreme Court against any Lokpal member and seek his removal. As for complaints against the staff of the Lokpal, they will be heard by an independent authority to be set up for this purpose.
Government's view: A Lokpal member can be removed only through a government's reference to the Supreme Court. This is evidently to discourage frivolous or motivated complaints. The complaints against its own staff will be investigated by the Lokpal itself.
Times View: The government seems to want to control both selection and removal of Lokpal members. That would defeat the very purpose of a truly autonomous Lokpal. So any citizen should be free to complain against a Lokpal member. As for complaints against the staff, allowing the Lokpal itself to investigate such complaints creates scope for conflict of interest. So, the separate body that deals with judicial accountability can deal with such complaints.

‎Sayan Sengupta ,Please read the FULL Janlokpal bill.

Posting for you the relevant sections-
"ACCOUNTABILITY OF LOKPAL
...Removal of Chairperson or members of Lokpal:
11. (1). The Chairperson or any other member of the Lokpal shall only be removed from his office by the President, on the recommendation of the Supreme Court on any of the following grounds after the Supreme Court, on the complaint of any person, held an inquiry and found that he could on such ground be removed :
(a) that he has been guilty of misbehavior; or
(b) that he is unfit to continue in his office by reason of infirmity of mind or body; or
(c) is adjudged an insolvent; or
(d) engages during his term of office in any paid employment outside the duties of his office.
(2) In any such proceeding the Supreme Court may also direct the suspension of such Chairman or member.
(3) On receipt of recommendation from the Supreme Court, the President shall forthwith remove the Chairperson or the member, as the case may be.
(4) Supreme Court shall, as far as possible, make its recommendations within 3 months of receipt of complaint under this section.
(5) If the complaint is frivolous or has been made with malafide intentions, Supreme Court may impose a fine or an imprisonment upto one year or both on the complainant."
---
Sayan, as per the above procedure , any person can make a complaint. This does not exclude person of Supreme court judge, So , in principal, the supreme court judge is onlly having powers to remove the lokpal , not the common person.

IAC-ap...ex says that if Lokpal is corrupt, SCjs will expel him.

Well we already have law that if MP is corrupt, HCjs/SCjs can imprison them and thus they will be expelled. for which they do not need permission of anyone . But what we always see that HCjs never prosecute corrupt MPs and let them walk away.

So this "SCjs will punish corrupt Lokpals" as useless as existing "HCjs will imprison corrupt MPs" provision.

Thats why we MUST demand Janlokpal with Right to Recall corrupt Lokpal clauses.

--------

SAyan , Do you oppose or suppose Janlokpal without right to recall -corrupt lokpal ?

If the transparent complaint procedure and RTR-corrupt lokpal is in place, and the lokpal is ignoring complaints which is of lakhs of people, the crores of citizens will come to know about this via the transparent complaint procedure .

Then ..., THE CRORES HAVE TO FIND A ALTERNATIVE. tHE CRORES pushing for a person will put suficient collective pressure, which will force existing lokpal to resign. This is mentioned in the procedure of RTR-lokpal.

Please see the full procedures at www.righttorecall.info/405.pdf
